ILLEGAL: Contrary to law. If I go to MEXICO without proper papers, I am an illegal alien and have committed a FELONY, under Mexican Law. I WILL BE IMPRISONED, according to Mexican law. The same applies to many other countries throughout the world.
I have heard the argument that the Europeans who came to the Americas so long ago were themselves illegals. They had neither visa nor passport. Although they had no such migratory instruments, the Spanish, English, Dutch, French etc who came to the Americas in centuries past were NOT ILLEGALS!
There were no laws established by any official government at that time. The original inhabitants of the Americas had no central governments -as we know them today- with flags, constitutions, and laws. They simply had tribal councils and rules which differed from tribe to tribe. There was no such rule anywhere prohibiting the migration from one place to another. Native Americans themselves migrated throughout history. Tribes migrated from place-to-place without regard to borders, quotas, passports, visas, etc. - and many migrated in order to conquor or enslave. To them, the new arrivals from Europe were just another band of migrants, albeit with a lighter skin color and vastly different customs.
Therefore ALL immigration, including that of other tribal groups, was, in fact,LEGAL - that is, not contrary to any existing laws or rules. Immigration issues, prior to the arrival of the Europeans, were resolved by either allowing the newly-arrived group to settle, or by intertribal treaties, adoption, enslavement, banishment, execution, or warfare.
The founders of the United States were NOT here illegally. Remember the MAYFLOWER COMPACT?
This document LEGALIZED these tempest-tossed immigrants, forming a legitimate government, and outlining basic rules by which the colonists were to govern themselves. Subsequent immigration came not illegally but rather by the invitation and approval of the government already in place. The land upon which the original settlers landed did not belong to anyone... it belonged to everyone - this according to the Native Americans - who lived on the land.
By Native American tribal laws, the original settlements were LEGAL. Those who reside at present in the Americas have NO CULPABILITY when it comes to injustices and outrages perpetrated by some of those colonists on native peoples 200-400 years ago, and WE HAVE THE LEGAL RIGHT TO BE HERE!!!
THEREFORE citizens of the United States of America HAVE THE RIGHT to their land, language, and laws. Those who choose to enter US territory must abide by those laws established by those who live here, just as Americans who travel overseas must abide by the laws of the lands to which they travel.
